About this Webcast:

“Fake news” – the online publication of intentionally or knowingly false statements of fact – has evolved in recent years into a passionately criticized Internet phenomenon. Fake news publications are conceived and disseminated (typically via social media) with hopes of going “viral,” typically for purposes of profit or social influence.

Attorneys David O. Klein and Joshua R. Wueller of Klein Moynihan Turco LLP believe that a backlash against fake news may soon come on many fronts. “As media attention and public condemnation of fake news continues to intensify,” they wrote recently, “we predict that more lawmakers, regulators, courts, and private citizens will explore legal and regulatory solutions that balance the societal importance of truth-seeking with the constitutional right to speak freely (and, at times, to lie).”

Why should this changing legal and regulatory landscape concern digital media publishers? What about law firms that publish blogs or use information from the Web? What do recent fake news events tell us? What existing laws have been utilized to target fake news publishers?

David O. Klein

David Klein is one of the most recognized attorneys in the technology, Internet marketing, sweepstakes and telecommunications fields. Skilled at counseling clients on a broad range of technology-related matters, he has substantial experience in negotiating and drafting complex licensing, marketing and Internet agreements. He has an in-depth understanding of Internet and new media law and is established as a leader in structuring and implementing major technology agreements. David represents clients before the New York State trial and appellate courts, federal courts, the Federal Communications Commission, the Federal Trade Commission, State Public Service Commissions, state attorneys general, as well as before the American Arbitration Association and other arbitral tribunals. David speaks and writes extensively on intellectual property, promotions and technology issues.

Joshua R. Wueller

Joshua Wueller is an associate with Klein Moynihan Turco LLP in New York, where he counsels digital media publishers, Internet marketers and other clients regarding a broad range of legal issues, including intellectual property protection and enforcement, dispute resolution, regulatory compliance, and the preparation and negotiation of commercial contracts. Josh frequently publishes and speaks on intellectual property and media-related legal issues. He was Editor-in-Chief of the Brooklyn Journal of Corporate, Financial & Commercial Law and Co-President of Brooklyn Law School’s Intellectual Property Law Association.

Education: B.A. 2009, University of North Texas; J.D. 2014, Brooklyn Law School.

Eric P. Johnson, J.D., Ph.D.

Eric Robinson is Assistant Professor in the School of Journalism and Mass Communications at the University of South Carolina, where he focuses on media law and ethics. An attorney and scholar focused on legal issues involving the media, including the internet and social media., he previously taught at Louisiana State University, the City University of New York Graduate School of Journalism, Baruch College (CUNY), and the University of Nevada, Reno. He was also co-director of the Press Law and Democracy Project at LSU; deputy director of the National Center for Courts and Media in Reno; and an affiliate scholar with the Digital Media Law Project at Harvard Law School’s Berkman Center for Internet and Society. Outside of academia, he was of counsel to First Amendment attorney Cynthia Counts; ; a staff attorney at the Media Law Resource Center; and a legal fellow at the Reporters Committee for Freedom of the Press. He has published articles in several academic, legal and professional journals, as well as contributed to several books and encyclopedias. He also maintains his own blog, bloglawonline.com, and is the media law columnist for the South Carolina Press Association.

Anne Urda

Anne manages day-to-day operations of the Law360 newsroom, with special emphasis on areas such as mergers and acquisitions, private equity, banking, energy and health. Develops plans for increasing web traffic. Works with Assistant Managing Editors to push out breaking news, ensure that the right stories are covered, and that the reporter’s headline and lede sell the story.
