Program Overview:
Join us for a discussion of the IBA’s Toolkit on Insolvency and Arbitration, the innovative tool recently published by the IBA Arbitration Committee to examine the intersection of insolvency and arbitration around the world. In this 90-minute interactive session, contributors to the Toolkit will serve as panelists from the US, England & Wales, and Europe, comparing and contrasting the approaches in their respective jurisdictions and how these differences in approach can influence the resolution of these issues in an arbitral forum. CLE credit will be available.
Topics include:
- How choice of law and conflict of laws issues can be central to determining the impact of insolvency on arbitration
- Under what circumstances parties might find their arbitration stayed in light of pending insolvency proceedings
- How arbitral procedures may be influenced by the opening of the insolvency
- Tips to ensure an enforceable arbitration award against an insolvent party
